Please read these Terms of Service ("Terms") carefully before using the AskMyVal website (the "Service") operated by us ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Use of Our Service

AskMyVal provides a web-based tool that allows users to create digital "Valentine's Day" proposal pages, timelines, and messages hosted on our platform.

You represent and warrant that you are at least 13 years old and have the legal capacity to enter into a binding agreement.

2. User-Generated Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights.

You represent and warrant that:

  • The Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms.
  • The posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

3. Prohibited Uses

You agree not to use the Service to create, upload, or share content that:

  • Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, or tortious;
  • Contains nudity, sexually explicit content, or pornography;
  • Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
  • Infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party;
  • Constitutes unauthorized or unsolicited advertising, junk or bulk email (also known as "spamming").

Violation Policy: We reserve the right, but do not assume the obligation, to review and remove any content that violates these Terms at our sole discretion, without notice or liability.

4. Fees and Refunds

Some features of the Service may require payment of fees. All fees are stated in U.S. Dollars.

  • Payment Providers: Payments are processed by third-party providers (Gumroad). We do not collect or store your payment information.
  • Refund Policy: Due to the digital nature of the product (instant access/creation), all sales are final and non-refundable, except as required by law.

5. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of AskMyVal and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. AskMyVal makes no representations or warranties of any kind, express or implied, regarding the operation of the Service or the information, content, materials, or products included on the Service.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that the Service is free of viruses or other harmful components. We are not responsible for any downtime or failure of the Service that occurs during your use of a generated page.

7. Limitation of Liability

In no event shall AskMyVal, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

8. Indemnification

You agree to defend, indemnify and hold harmless AskMyVal and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the Service is operated, without regard to its conflict of law provisions.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
